Three firefighters claimed injuries (spinal fusion, torn acetabulum and surgically repaired torn ACL) sustained in a 5 alarm fire at a 100 year old six story apartment building in the South Bronx on November 30, 2015. The client owned the building; evidence showed the fire was caused by a contractor repairing a leak on the roof who used an illegal torch. Plaintiffs claimed the building owner shared responsibility with the contractor under the Fireman’s Law GML §205-a (due to Fire Code Violations) and negligence theories. The jury returned a verdict against the contractor and found no liability for the client owner.
